Supreme Court of India directs the Labour Department to conduct a survey on IC formation by the employer under the POSH Act

The Honourable Supreme Court of India, in its order dated 12th August 2025, has directed Labour Departments of the respective states to conduct a survey to assess compliance with Section 4 of the Sexual Harassment of Women at Workplace (Prevention, Prohibition and Redressal) Act, 2013, which mandates all establishments with 10 or more employees to constitute Internal Committee (IC). The Internal Committee is responsible for inquiring into complaints of sexual harassment lodged by aggrieved women, and submitting its findings and recommendations to the Disciplinary Authority/Employer of the establishment for appropriate action.

The Labour Departments have been directed to complete the survey within six weeks from the date of the order, i.e., by 23rd September 2025.

All are requested to strictly comply with the provisions of the Sexual Harassment of Women at Workplace (Prevention, Prohibition and Redressal) Act, 2013, and also display a copy of the order constituting the Internal Committee at a conspicuous place of the establishment.
