Gujarat Shops and Establishments (RE & CS) (Amendment) Ordinance, 2025

The Honourable Governor of Gujarat, through a notification dated 16th December 2025, has promulgated the Gujarat Shops and Establishments (Regulation of Employment and Conditions of Service) (Amendment) Ordinance, 2025. The following are the key features of the amendment:
1. These amendments will take effect from 16th December 2025.

2. The threshold limit for the applicability of the Act has been revised from ten (10) or more workers to twenty (20) or more workers.

3. Establishments employing fewer than twenty (20) workers are required to submit a notification of having commenced the business to the relevant labour department.

4. The maximum working hours per day have been increased to ten (10) hours from nine (9) hours, subject to a weekly limit of forty-eight (48) hours.

5. There is no change in the weekly working hours limit.

6. Continuous working hours without a break have been increased to six (6) hours from five (5) hours.

7. Female workers shall be permitted to work from 9:00 PM to 6:00 AM in any shop or establishment, provided the following conditions are met:

• Provision for a rest room, night crèche, and ladies’ toilet.

• Adequate protection of their dignity, honour, and safety.

• Protection from sexual harassment (Compliance with the POSH Act, 2013)

• Transportation from the establishment to the doorstep of their residence.

8. The maximum overtime limit per quarter has been increased from one hundred and twenty-five (125) hours to one hundred and forty-four (144) hours.
