Conditions for employing women during the night shift – Haryana

The Government of Haryana, vide notification no. 11/26/2025-4Lab, dated 8th May 2025, in supersession of all earlier notifications, has notified certain conditions for granting exemption from the restriction of employing women during the night shift (8 PM to 6 AM) in IT/ITES, banking establishments, three-star or above hotels, hundred percent export-oriented establishments, logistics and warehousing establishments.

As per the condition, no application for a grant of exemption shall be entertained unless received by the Labour Commissioner or Chief Inspectors of Shops of Haryana within one month before the date of commencement of the period in respect to which the exemption is required. Such exemption will be valid for one year from the date of the order of exemption unless there is any change of security, transportation agreements, or other details of the employer.

Some of the key changes in the new notification from the previous notification are as follows:

• A condition to have a female security guard in the vehicle for the transportation of women during the night has been added.

• Women have been given the option to opt out of the transportation facility by giving their consent if they are willing to travel to and from the workplace by themselves.

• Option has been given to the employer to pool the transportation facility via tie-ups with external transporters.

• Women workers during the night shift are to be employed in a batch of not less than four; however, in IT/ITES, a quorum may be relaxed for any woman in a senior position who is earning more than rupees one lakh per month.

• Appropriate medical facilities shall be provided by engaging a doctor or female nurse during the night shift. However, the occupier may pool the ambulance services and other necessary medical facilities by tie-ups with nearby hospitals to meet any emergent situation during the night shift. Important telephone numbers, such as hospitals, ambulances, police, etc., shall also be displayed at prominent places.
