Conditions for employing women during the night shift – Chhattisgarh

The Government of Chhattisgarh, vide notification no. ESTB/4762/2025-LABOUR, dated 25th September 2025, has substituted Rule 7 of the Chhattisgarh Shops and Establishments (Regulation of Employment and Conditions of Service) Rules, 2021, with revised conditions for employing women during the night shift (9 PM to 6 AM) in any shop or establishment to which the Chhattisgarh Shops and Establishments (Regulation of Employment and Conditions of Service) Act, 2017, applies.

Some of the significant conditions are as follows:

1. Written consent of the woman worker shall be taken in Form 6 (Format is appended to the notification).

2. A minimum of 3 women workers should be employed during the night shift.

3. A transportation facility to pick up and drop off the women workers shall be available with sufficient security guards. Details of the vehicles, drivers and security guards shall be verified by the police, and a record of the same shall be kept by the employer.

4. A compliant box for women shall be maintained.

5. Phone numbers of the local police station, police control room, and women’s help centre shall be displayed at a conspicuous place in shops and establishments.

6. Provisions of the Maternity Benefit Act, 1961, shall be strictly followed.

7. The provisions of the Sexual Harassment of Women at Workplace (Prevention, Prohibition and Redressal) Act, 2013, shall be strictly complied with.

8. Information regarding the employment of women workers during the night shift shall be given in Form 7 (format is appended to the notification) through the web portal to the labour department before their employment.

Consequent to the above amendment, the requirement of taking permission from the labour department to employ women workers during the night shift has been removed.
