Maharashtra Jan Vishwas (Amendment of Provisions) Act, 2025

The Government of Maharashtra, vide notification dated 31st December 2025, has officially notified the Maharashtra Jan Vishwas (Amendment of Provisions) Act, 2025. The objective of this Act is to modify certain laws to decriminalise and rationalise specific offences, thereby promoting trust-based governance to facilitate both living and business operations in the State of Maharashtra.

This Act revises several state statutes, updating their penalty frameworks and establishing administrative procedures for compliance. The following are the statutes that have been amended:

  1. The Maharashtra Industrial Relations Act, 1947
  2. The Maharashtra Nursing Homes Registration Act, 1949
  3. The Maharashtra Stamp Act, 1958
  4. The Maharashtra Medical Council Act, 1965
  5. The Maharashtra Recognition of Trade Unions and Prevention of Unfair Labour Practices Act, 1971
  6. The Maharashtra State Tax on Professions, Trades, Callings and Employments Act, 1975
  7. The Maharashtra Shops and Establishments (Regulation of Employment and Conditions of Service) Act, 2017

Under the Maharashtra Shops and Establishments Act, a mechanism for adjudication and appeal has been established, transferring the process from criminal courts to administrative officers. For the purpose of determining and enforcing penalties, the State Government may designate an officer(s) not below the rank of Government Labour Officer to serve as the adjudicating officer(s), responsible for conducting inquiries and imposing penalties.

Several provisions see the reclassification of “penalties” as “fines” or “punishments” to align with a more modern, civil-first compliance framework.
