The Government of Assam, vide notification no. LGL.239/2022/272, dated 21st March 2025, has published the Assam Shops and Establishments Act, 2022. This Act regulates the conditions of employment in shops and commercial establishments. It also covers the establishments for public amusement or entertainment, and other related establishments.
As per Section 40 of the above Act, the Assam Shops and Establishments Act, 1971, shall be repealed due to the passing of the above enactment, provided that:
• Every appointment, order, rule, bye-law, regulation, notification, registration or notice made, issued or given under the provisions of the Act so repealed shall, in so far as it is not inconsistent with the provisions of this Act (Act of 2022), be deemed to have been made, issued or given under the provisions of this Act (Act of 2022), unless and until superseded by any appointment, order, rule, bye-law, regulation, notification or notice made, issued or given under this Act (Act of 2022).
• Any proceeding relating to the trial of any offence punishable under the provisions of the Act so repealed shall be continued and completed as if the said Act had not been repealed but had continued in operation, and any penalty imposed on such proceedings shall be recovered under the Act so repealed.
